The Local Project ‐ Free 1 year subscription contest (Promotion) is promoted by Fisher & Paykel Appliances Canada Inc. of 10-3755 Laird Road, Mississauga, ON L5L 0B3, Canada. (Promoter)
Entry is only open to legal residents of Canada (excluding those resident in Quebec or located in Quebec) who have reached the age of majority in their province or territory of residence at the time of entry. Employees (and their immediate families) of the Promoter, participating retailers, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, former spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister or first cousin. One entry per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Promotion Terms and Conditions or who tampers with the entry process. Errors and/or omissions may be accepted at the Promoter's discretion. Identification considered suitable for verification is at the Promoter's discretion. Incomplete or indecipherable entries will be deemed invalid.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
By participating in this Promotion, entrants acknowledge compliance with, and agree to be bound by, these Promotion Terms and Conditions. Entrants who do not comply with these Promotion Terms and Conditions are subject to disqualification by the Promoter, in the Promoter's sole discretion.
The promotion begins on (Promotion Start Date) and ends on (Promotion End Date), after which time the Promotion will be closed. Any entries received after Promotion End Date will be ineligible.
You can enter the Promotion by visiting https://www.fisherpaykel.com/ca/promotions/2024/win-1-year-subscription-the-local-project, following the prompts to the registration page, inputting the requested details and submitting the fully completed entry form. For this Promotion, receipt of an Internet entry occurs when the Promoter's server records the entry information. All entries, including the entry form, must be complete and correct. Valid entries received by the Promotion End Date will go into the draw to win the prize(s). Any cost associated with submitting the entry and the entry form is the entrant's sole responsibility. All entries and entry forms become the property of the Promoter.
Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Promotion, or any other methods not authorized by these Promotion Terms and Conditions, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Promoter’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Promotion Terms and Conditions are void.
There are a total of 10 prizes available to be won as follows: 1 Year Subscription to The Local Project (approximate retail value: $200 each). A 1 Year Subscription to The Local Project includes three print issues of each The Local Project, The Commercial Project and The Local Marketplace delivered to you. The prize is not transferable or exchangeable and cannot be taken as cash.
The odds of winning depend on the number of eligible entries received before the Promotion End Date.

Selected Entrants will be notified in writing within 5 business days of the Draw Date using the details listed on the Selected Entrant's entry form provided at the time of entry. Selected Entrants that do not or cannot accept a prize as awarded may be disqualified and a new Selected Entrant may be selected by random draw from the remaining eligible entries, in the Promoter's sole discretion. A signed copy of the Promoter's Declaration of Eligibility and Liability/Publicity Release form (Winner Release) must be received by the Promoter no later than
Selected Entrants will be deemed winners if they meet all of the eligibility criteria set out in these Promotion Terms and Conditions. If a Selected Entrant does not meet the eligibility criteria, they will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, Selected Entrants will be required to: (i) correctly answer the Promoter's skill‐testing math question; (ii) sign and return the Promoter's Winner Release; and (iii) comply with all other Promotion Terms and Conditions, all in the sole discretion of Promoter.
The winner takes the prize entirely at their own risk and indemnifies the Promoter in respect of any claim for accident, injury or property damage that may occur in connection with the prize. The winner is responsible for all insurance, tax or other costs that may be associated with the prize. Prizes must be accepted as awarded. Prizes, or any portion of a prize, cannot be combined with other discounts, promotions or special offers. If any prize, or any portion of a prize, is unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the prize with another prize of equal or greater value. Promoter is not responsible for any costs that are not specifically included in the prize, including, without limitation, meals, spending money, travel, visas, vaccinations or any other charges.
The Promoter is not responsible for: (i) incorrect or inaccurate entry information that may affect a person's ability to participate in the Promotion or be awarded a prize, including but not limited to human error, technical malfunctions, lost, delayed, misdirected or illegible entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Promotion Terms and Conditions; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Release; (iv) injury or damage to entrants’ computers or to any other individual's computer related to or resulting from participating in, or downloading any material regarding the Promotion or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize, including any related travel and the use of entries by Promoter; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third‐party computer hackers or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.
The Promoter reserves the right to terminate or amend this Promotion at any time and in any way, without prior notice to entrants. Without limiting the foregoing, if, for any reason, the Promotion is interfered with or not capable of running as planned for any reason, the Promoter reserves the right, in its sole discretion, (i) to disqualify any entrant, (ii) to modify, suspend, terminate or cancel the Promotion, and/or (iii) to conduct a random draw from all remaining eligible entries received by the Promotion End Date.
Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promotion is not valid in conjunction with any other offer, unless otherwise advised.
By entering the Promotion, entrants consent to the collection, use and distribution of their personal information (information that identifies an entrant as an individual, such as telephone number and address) by the Promoter for the purposes of implementing, administering and fulfilling this Promotion. The Promoter will only use or disclose the personal information of entrants for the specific purposes for which it was collected, including but not limited to the administration of the Event, unless required by law, and will only retain the information long enough to fulfill the purposes for which the personal information was collected. These Promotion Terms and Conditions are deemed to incorporate the Promoter's privacy policy and, by entering the Promotion, entrants accept the terms and conditions of the Promoter's Privacy Policy. If an entrant marks the applicable box, the Promoter and the prize supplier may use the entrant's personal information for the purposes specified at the time of collection. Entrants should direct any requests to access, update or correct information to the Promoter.
The Promotion is void where prohibited by law and is subject to all applicable Canadian federal, provincial, and territorial laws. This Promotion shall be governed exclusively by the laws of the province of Ontario, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Promotion Terms and Conditions, rights and obligations between entrants and the Promoter, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario.
The Promoter reserves the right, in its sole discretion, to amend or modify these Promotion Terms and Conditions, or modify, cancel, suspend or reschedule this Promotion, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Promoter corrupts, or threatens to corrupt, the security or proper administration of the Promotion.
The Promoter (or its associated or affiliated companies or third parties who have licensed its brands to the Promoter or contributed to the application) (Content Owner) own or license from third parties all application content. All application content remains the sole property of the applicable Content Owner and is protected under all relevant copyright, trade mark and other applicable laws. Nothing on the application should be construed as granting any license or rights to use or distribute any application content, without the Promoter's express written agreement or of the other applicable Content Owner.
This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Meta. Entrants understand that they are providing their information to the Promoter and/or agencies acting on its behalf and not to Facebook, Instagram or Meta.
By entering the Promotion, entrants agree that in no event will the Promoter or Facebook, Instagram or Meta, and their respective affiliates and their respective members, shareholders, directors, officers, employees, agents, representatives, successors, subcontractors, insurers and assigns, (collectively, the Released Parties) be responsible or liable for, and entrants hereby release such Released Parties from any and all claims, actions, damages, losses, costs, expenses or liability of any kind (including, but not limited to, property damage, personal injuries and/or death, direct, indirect, incidental, consequential or punitive damages, and counsel fees and court costs) arising or resulting from anything relating to or including, but not limited to:
The Released Parties are not responsible or liable for commencing, continuing or completing a draw or awarding prizes, including and without limitation in the following circumstances: (i) a regulatory body with authority over the Promotion, or over any of the Released Parties, has reservations of a regulatory nature about any element of the Promotion, or in any of the Released Parties offering or operating the Promotion; (ii) if doing so will result in the Promotion not being administered as intended by the Promotion Terms and Conditions; or (iii) if doing so may adversely affect the fairness, integrity or reputation of the Promotion or the integrity or reputation of any of the Released Parties, all in the Promoter’s absolute and unfettered discretion.
Entrants agree to defend, indemnify and hold harmless the Released Parties from and against any and all actions, suits, proceedings, claims, demands, losses, costs and expenses, including legal costs and fees, arising from or related to any entry in the Promotion and/or any breach of any of the Promotion Terms and Conditions.
All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Promoter.
