Cancellation and Returns Policy

Effective from 13 June 2014.

Amendment

This Cancellation and Returns Policy may be amended by us from time to time, at our discretion, upon notice to you (including without limitation by publishing an updated Cancellation and Returns Policy on our Website). By continuing to use our Website and/or placing orders on our Website, you will be deemed to have accepted our updated Cancellation and Returns Policy. Our current Cancellation and Returns Policy from time to time will be accessible from a link at the bottom of our Website.

You will be subject to the Cancellation and Returns Policy in force at the time that you place an order for Products and/or Services via our Website.

Right to Cancel

You have the right to cancel this contract within 14 days without giving any reason.

In the case of a contract for the supply of Products, the cancellation period will expire after 14 days from the day on which you, or a person identified by you, acquires physical possession of the Products or, if the contract is for multiple Products delivered on different days, the cancellation period will expire after 14 days from the day on which you, or a person identified by you, acquires physical possession of the last of the Products.

In the case of a contract for the supply of Services the cancellation period will expire after 14 days from the day of the conclusion of the contract.

You may use the attached model cancellation form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of Cancellation

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery to you (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We may make a deduction from the reimbursement for loss in value of any Products supplied, if the loss is the result of unnecessary handling by you. You are only liable for any diminished value of the Products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Products.

We will make the reimbursement without undue delay, and not later than-

  1. 14 days after the day we receive back from you any Products supplied, or
  2. (if earlier) 14 days after the day you provide evidence that you have returned the Products, or
  3. if there were no Products supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the Products back or you have supplied evidence of having sent back the Products, whichever is the earliest.

You shall send back the Products or hand them over to us at Fisher & Paykel Appliances Limited Maidstone Road, Kingston, Milton Keynes, MK10 0BD, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the Products before the period of 14 days has expired.

You will have to bear the direct cost of returning the Products.

If you requested to begin the performance of Services during the cancellation period, you shall pay us an amount which is in proportion to what has been performed until you have communicated us your cancellation from this contract, in comparison with the full coverage of the contract.

If you requested to begin the performance of Services during the cancellation period and we complete the Services during the cancellation period, you will lose your right to cancel the contract.
